Terms of Service

1. Who we are

Tuition Manager is operated by TECHZONE MALL LTD, a business registered in Kenya ("Tuition Manager," "we," "us"). These Terms govern your use of the Tuition Manager platform at techzonemall.co.ke, including the website, dashboard, and any related services (the "Service").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

2. What the Service does

Tuition Manager is a marketplace connecting students and parents/guardians with independent, verified teachers for online tuition classes, and reviewers who assess teaching quality. Classes are scheduled, booked, and paid for through the platform; payment for a class or a lesson package is made via M-Pesa.

We verify teachers before they may publish classes, but we do not employ teachers, and we do not guarantee the outcome of any class, tutoring relationship, or academic result.

3. Accounts and eligibility

  • You must provide accurate information when registering, and keep your phone number and email up to date -- both are used to verify your identity, deliver booking confirmations, and recover your account.
  • Anyone 18 or older may register directly as a Student.
  • Anyone under 18 may not create their own account. Accounts for a minor are created strictly using the parent or legal guardian's own name, phone number, and email -- never the minor's -- and that parent/guardian registers as Parent/Guardian and manages all bookings, payments, and communications on the minor's behalf. Creating an account for a minor in this way is the parent/guardian's consent to these Terms and to our Privacy Policy on the minor's behalf.
  • Teachers must complete our verification process (identity documents, subject/grade approval) before they may publish or teach a class.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • We may suspend or terminate an account that violates these Terms, provides false information, or poses a safety risk to other users -- particularly minors.

4. Bookings and payment

  • Prices are shown in Kenyan Shillings (KES) before you book. Reserving a seat holds it temporarily; you must complete payment within the reservation window shown, or the seat is released back to other students.
  • Payment is processed via M-Pesa. We do not store your M-Pesa PIN or full payment card details -- we never ask for either.
  • A booking is confirmed once payment clears. You'll receive a confirmation and, closer to the class, a join link.
  • Lesson packages let you pre-purchase a bundle of lessons at a package rate; package lessons are consumed as you book classes against them.

5. Cancellations and refunds

We do not offer cash refunds. If a class is cancelled -- by you, by the teacher, or by us -- before it takes place, any amount paid may be issued as credit toward a future class or package, at our discretion, rather than returned as cash to your M-Pesa account.

If a teacher fails to show up for a confirmed class, contact us through Support and we will review the case individually. We aim to resolve legitimate cases with class credit within a reasonable time.

6. Referral / commission program

Some users participate as Salespeople, referring new students via a personal referral code. If you were referred using such a code, a portion of your payments contributes to that person's commission under our revenue-sharing arrangement -- this does not change the price you pay. Commission terms for Salespeople are set separately by us and may change.

7. Conduct

You agree not to:

  • Share your account, join links, or class recordings with anyone who hasn't paid for access.
  • Harass, discriminate against, or behave inappropriately toward another user, especially a minor.
  • Attempt to arrange payment or tutoring outside the platform to avoid fees.
  • Upload false documents during teacher verification.
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.

We may suspend or terminate accounts that violate this section, and report unlawful conduct (particularly anything endangering a minor) to the appropriate authorities.

8. Content and intellectual property

The Tuition Manager name, platform, and software are our property or that of our licensors. Curriculum materials, class recordings, and content a teacher creates remain that teacher's, subject to the license they grant students who book their classes to use that content for personal learning.

9. Liability

The Service is provided "as is." To the fullest extent permitted by Kenyan law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including the conduct of teachers, students, or other users, or the outcome of any tutoring relationship. Nothing in these Terms limits liability that cannot be limited under Kenyan law.

10. Changes to these Terms

We may update these Terms from time to time. We'll update the date at the top of this page; continued use of the Service after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Kenya. Any dispute will be subject to the exclusive jurisdiction of the courts of Kenya.
